Wir freuen uns über euren Besuch. Diese Website kommt ohne Tracking, Analyse-Tools und Werbe-Cookies aus. Hier steht, welche Daten trotzdem technisch anfallen und was damit passiert.

2. Hosting und Server-Logfiles
Die Website wird bei Wix.com Ltd., Nemal Tel Aviv St. 40, Tel Aviv 6350671, Israel, gehostet. Beim Aufruf der Seite verarbeitet der Hoster automatisch Daten, die euer Browser übermittelt: IP-Adresse, Datum und Uhrzeit des Zugriffs, aufgerufene Seite, Referrer-URL, Browsertyp und Betriebssystem. Das ist nötig, um die Seite sicher und stabil auszuliefern. Rechtsgrundlage ist Art. 6 Abs. 1 lit. f DSGVO (berechtigtes Interesse an einem sicheren und funktionsfähigen Webauftritt). Mit Wix besteht ein Vertrag zur Auftragsverarbeitung. Für Israel liegt ein Angemessenheitsbeschluss der EU-Kommission vor; soweit Daten in andere Drittländer (z. B. USA) gelangen, stützt sich Wix auf Standardvertragsklauseln bzw. das EU-US Data Privacy Framework. Wie lange Wix diese Daten speichert, richtet sich nach den Vorgaben von Wix; mehr dazu in der Datenschutzerklärung von Wix. Ohne diese Daten kann die Seite technisch nicht ausgeliefert werden.
3. Konzerttermine, Fotos und Songs
Termine, Fotos und Songliste werden beim Laden der Seite aus der Datenbank von Wix abgerufen (wixapis.com, static.wixstatic.com). Dafür wird eine anonyme Besucherkennung ohne Personenbezug erzeugt; technisch bedingt wird dabei eure IP-Adresse an Wix übertragen. Rechtsgrundlage ist Art. 6 Abs. 1 lit. f DSGVO.
4. Cookies und lokaler Speicher
Wir setzen keine Tracking- oder Marketing-Cookies. Im lokalen Speicher eures Browsers (Local Storage) legt die Seite zwei Einträge ab: eure Sprachauswahl (DE/EN, Eintrag „niceinc-lang“) und die anonyme Besucherkennung für den Abruf der Inhalte aus Abschnitt 3 (Eintrag „wix-visitor-…“). Beides ist technisch erforderlich, enthält keine Angaben zu eurer Person und kann jederzeit über die Browsereinstellungen gelöscht werden (§ 25 Abs. 2 Nr. 2 TDDDG). Der Hoster kann technisch notwendige Cookies setzen, etwa zur Absicherung gegen Angriffe oder zur Lastverteilung.
5. Schriftarten
Die Schriftarten werden vom Server unseres Hosters Wix (static.wixstatic.com) geladen. Es wird keine Verbindung zu Google Fonts oder anderen Schrift-Anbietern aufgebaut.
6. YouTube-Videos
Im Bereich „Videos“ zeigen wir Videos von YouTube (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland) im erweiterten Datenschutzmodus (youtube-nocookie.com). Beim Aufruf der Seite wird keine Verbindung zu YouTube aufgebaut; die Vorschaubilder liegen auf unserem Server. Erst wenn ihr ein Video anklickt, wird es von YouTube geladen. Dabei werden unter anderem eure IP-Adresse und Geräteinformationen an YouTube übertragen, YouTube kann Cookies oder ähnliche Technologien einsetzen, und eine Übermittlung in die USA ist möglich (Google ist nach dem EU-US Data Privacy Framework zertifiziert). Rechtsgrundlage ist eure Einwilligung durch den Klick (Art. 6 Abs. 1 lit. a DSGVO, § 25 Abs. 1 TDDDG). Ihr könnt sie jederzeit widerrufen, indem ihr keine Videos mehr startet und die YouTube-Cookies in eurem Browser löscht. Mehr: Datenschutzerklärung von Google.
7. Links zu Spotify, Instagram & Co.
Wir verlinken auf Spotify, Apple Music, Tidal, YouTube, Instagram und TikTok. Es handelt sich um einfache Links, nicht um eingebettete Inhalte: Daten werden an diese Anbieter erst übertragen, wenn ihr einen Link anklickt. Ab dann gelten die Datenschutzbestimmungen des jeweiligen Anbieters.
8. Kontakt per E-Mail oder Telefon
Wenn ihr uns schreibt oder anruft, verarbeiten wir eure Angaben (z. B. Name, E-Mail-Adresse, Inhalt der Anfrage), um die Anfrage – etwa eine Booking-Anfrage – zu bearbeiten. Rechtsgrundlage ist Art. 6 Abs. 1 lit. b DSGVO, soweit es um einen (möglichen) Vertrag geht, sonst Art. 6 Abs. 1 lit. f DSGVO. Wir löschen die Daten, sobald sie nicht mehr gebraucht werden und keine gesetzlichen Aufbewahrungspflichten bestehen.
9. Eure Rechte
Ihr habt das Recht auf Auskunft (Art. 15 DSGVO), Berichtigung (Art. 16), Löschung (Art. 17), Einschränkung der Verarbeitung (Art. 18) und Datenübertragbarkeit (Art. 20). Eine kurze Mail an band@niceinc.de genügt.
Widerspruchsrecht (Art. 21 DSGVO)
Soweit wir Daten auf Grundlage von Art. 6 Abs. 1 lit. f DSGVO (berechtigtes Interesse) verarbeiten, könnt ihr aus Gründen, die sich aus eurer besonderen Situation ergeben, jederzeit widersprechen. Wir verarbeiten die Daten dann nicht mehr, es sei denn, wir können zwingende schutzwürdige Gründe nachweisen, die eure Interessen überwiegen, oder die Verarbeitung dient der Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen.
Außerdem könnt ihr euch bei einer Datenschutz-Aufsichtsbehörde beschweren, zum Beispiel beim Bayerischen Landesamt für Datenschutzaufsicht (BayLDA), Promenade 18, 91522 Ansbach, www.lda.bayern.de.

2. Hosting and server log files
This website is hosted by Wix.com Ltd., Nemal Tel Aviv St. 40, Tel Aviv 6350671, Israel. When you visit, the host automatically processes data sent by your browser: IP address, date and time of access, page requested, referrer URL, browser type and operating system. This is necessary to deliver the site securely and reliably. Legal basis: Art. 6(1)(f) GDPR (legitimate interest in a secure, working website). A data processing agreement is in place with Wix. Israel is covered by an EU Commission adequacy decision; where data is transferred to other third countries (e.g. the USA), Wix relies on standard contractual clauses or the EU-US Data Privacy Framework. How long Wix keeps this data is governed by Wix; see the Wix privacy policy. Without this data the site cannot be delivered.
3. Tour dates, photos and songs
Tour dates, photos and the song list are loaded from Wix's database when the page opens (wixapis.com, static.wixstatic.com). An anonymous visitor ID with no link to your person is created for this; for technical reasons your IP address is transmitted to Wix. Legal basis: Art. 6(1)(f) GDPR.
4. Cookies and local storage
We do not use tracking or marketing cookies. The site stores two entries in your browser’s local storage: your language choice (DE/EN, key “niceinc-lang”) and the anonymous visitor ID used to load the content described in section 3 (key “wix-visitor-…”). Both are strictly necessary, contain no personal details and can be deleted at any time in your browser settings (§ 25(2) no. 2 TDDDG). The host may set strictly necessary cookies, e.g. for protection against attacks or for load balancing.
5. Fonts
Fonts are served from our host Wix (static.wixstatic.com). No connection is made to Google Fonts or any other font provider.
6. YouTube videos
In the “Videos” section we show videos from YouTube (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland) in privacy-enhanced mode (youtube-nocookie.com). No connection to YouTube is made when the page loads; the preview images are stored on our server. A video is only loaded from YouTube once you click it. YouTube then receives, among other things, your IP address and device information, may use cookies or similar technologies, and data may be transferred to the USA (Google is certified under the EU-US Data Privacy Framework). Legal basis: your consent by clicking (Art. 6(1)(a) GDPR, § 25(1) TDDDG). You can withdraw it at any time by not starting any more videos and deleting YouTube cookies in your browser. 7. Links to Spotify, Instagram & co.
We link to Spotify, Apple Music, Tidal, YouTube, Instagram and TikTok. These are plain links, not embedded content: no data is sent to these providers until you click a link. From then on, the respective provider's privacy policy applies.
8. Contact by email or phone
If you write to us or call us, we process your details (e.g. name, email address, content of your message) to handle your request, such as a booking request. Legal basis: Art. 6(1)(b) GDPR where a (potential) contract is concerned, otherwise Art. 6(1)(f) GDPR. We delete the data once it is no longer needed and no statutory retention periods apply.
9. Your rights
You have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18) and data portability (Art. 20). A short email to band@niceinc.de is all it takes.
Right to object (Art. 21 GDPR)
Where we process data on the basis of Art. 6(1)(f) GDPR (legitimate interest), you may object at any time on grounds relating to your particular situation. We will then stop processing the data unless we can demonstrate compelling legitimate grounds that override your interests, or the processing serves the establishment, exercise or defence of legal claims.
You may also lodge a complaint with a data protection supervisory authority, for example the Bavarian Data Protection Authority (BayLDA), Promenade 18, 91522 Ansbach, Germany, www.lda.bayern.de.
